Welcome to NavSim Academy. These Terms of Service govern your use of our website and the purchase and use of our radar simulator software, training materials, documentation, videos, downloads, and related content.
By using this website or purchasing our software, you agree to these Terms. If you do not agree, please do not use the website or purchase the product.
The NavSim Academy radar simulator is intended for education, training, practice, and general learning about marine radar operation. It is not a certified navigation system, not a substitute for professional instruction, and not a replacement for real-world training, licensed instruction, official navigation equipment, prudent seamanship, or applicable maritime rules and regulations.
You should not rely on the simulator as your sole source of radar, navigation, collision avoidance, or boating safety knowledge.
When you purchase the radar simulator, you are purchasing a license to use the software, not ownership of the software itself.
Unless otherwise stated in writing, your purchase gives you a personal, non-exclusive, non-transferable license to install and use the software for your own personal or educational use.
You may not:
Training videos, manuals, images, diagrams, scenarios, written materials, and other course content are protected by copyright. You may use them for your own learning, but you may not copy, publish, upload, redistribute, sell, or publicly display them without written permission.
If videos are hosted through a third-party service such as YouTube, your use of those videos may also be subject to that service’s terms.
The radar simulator may require a compatible computer, operating system, graphics capability, storage space, and internet access for download, installation, updates, licensing, or support.
Before purchase, you are responsible for confirming that your computer meets the stated system requirements. If the software does not run properly on your computer, please contact us during the refund period.
We may update, improve, modify, or discontinue parts of the software, website, documentation, or training materials at any time. We may also correct errors, fix bugs, change features, or update system requirements.
We are not obligated to provide every future update free of charge unless we specifically state otherwise.
Purchases may be processed by a third-party payment provider. We do not directly receive or store your full credit card number or payment card details. Payment processing is handled by the applicable payment provider under its own terms and privacy practices.
Prices, taxes, and availability may change at any time.
We stand behind the radar simulator and offer a 14-day full money-back guarantee. Please see our separate Refund Policy for the full terms.
We will make reasonable efforts to help customers install and use the software. Support may be provided by email or other methods we choose.
Support does not include customized training, computer repair, operating system troubleshooting, network troubleshooting, or support for unrelated third-party software or hardware, unless we choose to provide such help at our discretion.
You agree not to use the website, software, or materials in a way that:
All software, text, videos, images, graphics, diagrams, trademarks, logos, product names, scenarios, and other materials on the website or included with the radar simulator are owned by NavSim Academy, its owners, licensors, or content providers.
Nothing in these Terms gives you ownership of our intellectual property.
The website, software, and materials are provided “as is” and “as available.” We make reasonable efforts to provide a useful and reliable product, but we do not guarantee that the website or software will be uninterrupted, error-free, compatible with every system, or suitable for every purpose.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, NavSim Academy and its owners, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, business interruption, or damages arising from use of or inability to use the website, software, or materials.
Our total liability for any claim related to the website, software, or materials will not exceed the amount you paid for the product giving rise to the claim.
The simulator is a training aid only. Marine navigation involves real-world risks. You are responsible for using official navigation equipment, current charts, radar, AIS, GPS, visual observation, sound signals, applicable rules of the road, and prudent seamanship when operating a vessel.
The simulator should not be used for actual vessel navigation.
Our website or materials may link to third-party websites, services, videos, payment processors, hosting providers, analytics tools, or download services. We are not responsible for third-party content, policies, or practices.
We may suspend or terminate access to the software, website, downloads, license keys, or materials if we believe you have violated these Terms, abused the refund policy, attempted unauthorized distribution, or engaged in unlawful or harmful conduct.
We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the website or software after changes are posted means you accept the updated Terms.
